Why Divorce Real Estate?

During the 2007-2010 downturn in the housing market I worked with many homeowners that were losing their home to short sale or foreclosure and many of them were also going through a divorce which made the situation even worse.  I saw then and continue to see now how some agents and buyers see a divorce sale as a “distressed or must sell” opportunity and one they can take advantage of.  Many of the divorce related sales had most if not all of their assets tied up in the equity of their home and needed to get every dollar they could from the sale of the home.  I saw many of these sellers get bad information from their real estate agent or worse, had their agent contribute to the feeling of a “distressed sale”.  

I wanted to make sure that when I got involved these sellers would be protected so I sought out training programs that would enable me to better help these sellers.

In 2018 I completed a comprehensive divorce real estate training program through the Ilumni™ Institute and became a Certified Divorce Real Estate Expert (CDRE™).  As a member of the Ilumni™ Institute, the goal is to transform the collaboration between real estate and family law professionals, such that every divorcing couple is ensured the best possible outcome when untangling the legal, financial and emotional ties to their house.  The program is designed to promote neutrality, communication, and empowering divorcing spouses to set themselves up for a faster road to recovery. This approach can result in reduced court time, better informed attorneys, minimized costs, maximized property value, and better efficiency so that the listing and the case can keep moving forward.

Meet Barbara Woyak

Frustrated by a bad experience, Barbara began her real estate career specializing in residential real estate with a goal of providing exceptional service. Our team motto is “A Name Friends Recommend." If you have a great experience with us  then you will want your friends and family to have that same great experience.

Barbara has been a full-time agent since 2005 and is a resident of the area since 1990. This extensive experience and knowledge of the community serve as an asset to buyers and sellers of residential real estate in the Phoenix/Scottsdale area. Barbara has a MBA from Clark University and specialized in marketing and consumer behavior. Understanding how and why buyers buy will help you get the best deal possible on the purchase or sale of your home.

CDRE CODE OF ETHICS

A Court-Appointed Realtor is an active Realtor who has an expanded duty to the Court, over and above their fiduciary duty and the ethical standards set forth by the National Association of Realtors.

Sometimes, the Court will appoint a Realtor in a family law case to list and sell the property as a Real Estate Special Commissioner.

Barbara Woyak qualifies as a Real Estate Special Commissioner and abides by the Ilumni Institute Code of Ethics when she is Court Appointed.

  • No, AZDR does not charge a premium or additional fees for our services. In fact, our rates are very competitive and can be based on a sliding scale, depending on the dynamics of the case.

  • By having training and experience in divorce listings, we often identify problems a mile ahead. Very simple things, such as our intake process and showing coordination, keep a listing on its tracks, whereas applying regular listing practices almost always complicates and delays a situation.

  • Yes, Barbara is a Certified Divorce Real Estate Expert (CDRE™) through the Ilumni Institute.

  • That is up to you. Working with our office, we assume there is no communication between you and your ex, so it's not necessary. We communicate with each of you separately, ensuring you have the space to be transparent and heard, while keeping you both equally informed about the process, the status, and what to expect in the next step.

  • Yes. We know that good communication means efficiency and can keep fees under control. There are five points in time that we email the attorneys in the case so that they’re aware of what’s going on, including sharing a copy of the closing statement and ensuring that we have the most current court order. Our intent is to keep attorney involvement to a bare minimum; however, we do reach out when we need clarification on something, or if despite our best efforts, we reach an impasse.

  • We take every measure necessary to ensure that you and your ex will not be together throughout the process and that restraining orders are not violated.

  • It all begins with making your house look its best, and we do this through a market-specific analysis, project coordination, staging, and professional photography. We then launch a marketing campaign that includes social media, strategic syndication to consumer sites (such as Zillow and Redfin) including international platforms, agent-to-agent connections, open houses, and when appropriate, cash investors.

  • We do. There are some instances where time is of the essence and it makes sense to sell to an investor, especially if the house is in such disrepair that it will not qualify for financing or it is facing imminent foreclosure. We’ve got long-standing relationships with very reputable investors if we need to call upon them.

  • No. Since we serve those going through divorce, we are appointed to all types of cases that go through the court system. We have listed homes from those that are uninhabitable, to luxury homes in the Phoenix/Scottsdale metro area’s most elite neighborhoods, and everything in between. All require a unique approach, and our broad experience can accommodate any and all neighborhoods.

  • Yes. We have a commercial affiliate with whom we co-list vacant land and commercial properties.

  • Yes. Our office has a department that handles securing rental properties for our clients. They will assist with preparing a strong application, searching for properties both on and off the market, setting up tours, ensuring the listing is not fraudulent or in foreclosure, and coordinating movers or other services you may need.

  • Yes. We partner with a lender who holds a special designation, Certified Divorce Lending Professional (CDLP®), and they will assist you in making sure you are in a position to obtain a loan, and will explain all your options to you. Once you are ready, we will connect you with one of the agents in our office, who will represent you in the purchase of your new home!

  • Yes. Since 2018, Barbara has been a Certified Divorce Real Estate Expert (CDRE™) and has worked in the Phoenix area family law community, and is qualified to testify about real estate matters in family law cases. She is aware of the processes, and is comfortable and confident testifying in front of judicial officers.

  • We serve the greater Phoenix area. We also have a network of Certified Divorce Real Estate Experts throughout Arizona and the nation, should you have a property located outside of our service area.
